Discovery in disarray.... ?

Nice. This coming from the man who, out of pure spite, spent half of last year trying to prevent Landis from having any sort of success at all.

The ego requires that he take some credit, I guess. Particularly since Disco doesn't have much to crow about at the TdF this year. But, yeah, Lance's attitude towards Landis two years ago and then his saying this year that things were blown out of proportion is humorous. I guess the pointing incident at the Tour de Georgia was just harmless fun, eh? *laugh* Everyone knows that Lance held a grudge against Landis and wanted to do whatever he could to make Landis regret his decision to leave.

I hope he can find room in his trophy case for that moral victory... hmmm, maybe under one of those stuffed lions...
...

Better than the teams that don't even have moral victory, that didn't nurture Landis in his pro financy as a non-mountain-bike cyclist. :p

Big chunk of credit to Bruyneel.
Well, my view is that LA is pretty accurate, up until his last phrase. So DC does get "some credit," "not a lot." That is fair. And "took something" seems appropriate. As for "honor," well, a bit two-faced given LA's own personal attitude toward Landis. If only Lance had stopped before the "moral victory" part, that was just too much. I would have preferred that he keep completely quiet, however.

But the last sentence, musette, is yours. I know you get some abuse in this forum, but please, in a case like this you deserve it. "Big chunk of credit" is absurd. As I summarize above, LA himself was measured, learn from that.

"Spokesman Christian Frommert confirmed that changes were on the cards after the sponsor demanded an investigation into the “fundamental structure and personnel” within the team, before going on to speak of a necessary “Klinsman effect” - a revamping of its public image after recent involvement in doping scandals."

So Phonak got 400,000 Euros, what was the 7 Mil that LA was fighting over? I thought it was tour money?
It was a $5 million bonus promised to him by his team for winning his sixth tour -- the team purchased insurance against the risk, and the insurance company tried to deny the claim on the basis of the doping allegations against Armstrong. Armstrong received a ruling in Feb. that he was entitled to his money.

It was a $5 million bonus to be paid him, by a company called SCA, if he won the 2004 Tour. SCA lost the case and paid $7.5 million in bonus, interest, and attorneys fees. I do not know why the bonus was due - I don't know why the bonus contract was set up, or by whom.

The insurance contract was set up by the people who had the cycling contract with LA (an entity affiliated with LA and Bruyneel and others). I don't know if it required consecutive wins or just total wins, but the insurance was set up to allow LA to reap big financial rewards if he won more and more TdFs. I think it was set up before he won two or three.

Cool. Seems lke 400,000 isn't a ton of money for winning the biggest race in the world. Doesn't suck of course, but a little surprising. Thanks for clearing up my question. :)

They did not lose the case. They settled after the arbitrator ruled that they were acting as an insurance company and could be liable for triple damages under some sort of Texas law about insurance cases.

was it a mediator? it's been awhile since i've taken any law classes, but form what i remember once the parties agree to arbitration the arbitrator's ruling is binding.

Considering that the money is split amongst the team, it is a small amount. Looking at the prize money for a large golf or tennis tourney puts things into perspective.

Riders do post-Tour races as a way to capitalize on their Tour success. They get paid start money.

There was no judgement. There was no arbitor. The case was proceeding through the courts but the parties decided to settle out of court. Any speculation as to why is just a guess.

A mediator is usually an attorney that has a designation to act as such.In my state you must be registered as such. They try and persuade two parties to come to an agreement through indirect negoitation while they are in separate rooms.
Either or both parties can reject offers from the other.
A mediator does not have any decisive powers. They can only deliver information back and forth and present it in a format that is in theory condusive to settlling the claim or claims.
It has been said that a successful mediation is when both parties feel they have lost to some degree. Some work and some do not and the parties end up in court.
I have been to many!
An arbitrator does have decision making authority, but that is another story and wasn't your question.

thanks to you and Bro Deal for the correction. Speculation is always speculation, but there are varying degrees of informed speculation. In this case we have the extent of the settlement, entirely in favor of LA (and I'm not a fan of his) including interest and attorneys fees, which is a useful although not definitive point of information regarding the evidence at hand.

Supposedly Landis had a 2.5 million Tour win bonus in his contract with Phonak. Not sure if that is dollars or euros.

Isn't it customary for the winner to let his team split the entirety of the Tour money, keeping a share of zero for himself? I vaguely recall LA doing that.

Not a big deal for a rider to give up 50K when they are getting 2500K as a bonus on the side!
