International reports: Woman has no name in Turkey

Though Turkish women were granted rights far more advanced
and far earlier than those granted to women in many European
countries, it is taking some time for these reforms to be
absorbed by Turkish society.

Mustafa Kemal Ataturk, founder of Turkey, put into action a
series of reforms within the modernization policy of the
country and women reached rights equal to that of men in
education, health, labor, politics, law, the arts and the
science about 80 years ago.

However, it has taken a long time - a much longer time than
the European countries - for Turkey to absorb these rights
granted to women. Turkey is having problems in clearly
interpreting and implementing the laws that are being
legislated.

Male-dominant perception still remains strong and women's
rights are still violated in Turkey.

Recent international reports on Turkey, 80 years after
women's rights were granted, emphasize lack of
implementation of laws on the issue and the social pressure
on women that prevent them from using their own rights.

Honor killings

Honor killings - the killing by immediate family members of
women suspected of being unchaste - take the front-line
among the major issues regarding the violation of women's
rights in many international reports on Turkey.

The 2003 Progress Report by the European Union mentioned the
recent amendment of the penal code to facilitate the
prosecution of "honor killings," but noted that more general
provisions which make a ruling dependent on interpretation
of the judge makes the amendment meaningless.

"With respect to gender equality, as part of the sixth
reform package the Penal Code has been amended in order to
address concerns related to the perpetration of 'honor
killings.' Article 462 of the Penal Code, allowing for
reduced sentences for so-called "honor killings," has been
repealed. However, the more general provisions of Article
51, related to crimes committed under 'extreme provocation,'
remain, applicable for offences traditionally viewed as
being against 'virtue'."

The U.S. report on human rights released last week also
addressed the issue. It said the Parliament revoked a law in
July under which perpetrators of honor killings received
reduced sentences, it left intact another law allowing for
reduced sentences for crimes committed "in the heat of
anger" or under "unjust provocation."

The report noted that perpetrators of honor killings
continued to benefit from sentence reductions under this
law. Because of sentence reductions for juvenile offenders,
observers noted that young male relatives often were
designated to perform the killing.

The U.S. report also said: "Honor killings continued in
rural areas and among new immigrants to cities; according to
media reports, there could be dozens of such killings every
year. They were most common in conservative, Kurdish
families in the southeast or among migrants from the
southeast living in large cities."

Violence against women within the family

Another issue that tops the international reports is the
violence against women within the family which is still very
common in Turkey.

The U.S. report emphasizes the issue, adding that though
many laws were legislated to protect rights of women on this
issue, many women were prevented from benefitting from these
laws due to social pressure.

"Violence against women remains a problem, and spousal abuse
was serious and widespread. The law prohibits spousal abuse;
however, complaints of

so. The Law for Protection of Family provides that victims
of spousal violence may apply directly to a judge for
assistance. The law authorizes judges to warn abusive
spouses and order them to stay away from the household for
six months. Judges may order further punishments for those
who violate such orders. According to women's rights
advocates, authorities enforced the law effectively,
although outside of major urban areas, few spouses sought
assistance under the law."

"Spousal abuse was considered an extremely private matter
involving societal notions of family honor, and few women
went to the police. Police were reluctant to intervene in
domestic disputes and frequently advised women to return to
their husbands."

"The law allows women to apply for restraining orders
against their husbands and therefore to avoid having to
leave their own homes. Observers and government officials
noted that this provision has been very successful in some
of the cities of the country, but less so in the more
traditional southeast."

Rape

The U.S. report criticized some of the regulations in the
penal code on the issue of rape, calling them as
"discriminatory to women." The report placed the
discriminatory penal code articles which provide that:
"Rape is considered a crime against society, rather than a
crime against the individual; rape between spouses is not
legally considered rape; rapists and kidnappers may avoid
punishment if they marry their victims; and punishment for
rape is greater if the victim is married, lesser if the
victim is single, and even less if the victim is single and
not a virgin."

Women's employment

The EU progress report criticized Turkey's failure to
promote gender equality in the employment of women; "The new
Labour Law of May 2003 recognizes the principle of equal
treatment in employment between persons irrespective of
gender, as well as racial and ethnic origin, religion and
ideology. However, legislation does not yet guarantee the
effective prohibition of discrimination in employment and
further efforts are needed to promote gender equality, as
laid down in EU legislation."

The U.S. report noted that women's taking posts were very
common in Turkey, however, not the managerial level posts:
"Particularly in urban areas, women were well represented in
the professions, business, and the civil service and
constituted more than one-third of university students.
However, they continued to face discrimination in employment
to varying degrees. Women were generally under-represented
in managerial-level positions."

Women in politics

Both the U.S. report and the EU's progress report emphasized
the point that representation of women in elected bodies and
government remained low. The EU report noted that only twenty-
four out of 550 members of the Parliament are female.

European Union, the reforms brought about are insufficient

"Ever since the new government is there, the practice of
torture has been continued", adds Dogan Ozgüden, editor in
chief of the online bulletin Info-Türk. "To join the EU,
turkey has to change its mentality", he said, specifying
that in the country there are 50.000 prisoners, of them
10.000 political prisoners.

Though women of any social or cultural origin are
susceptible to such maltreatment, some are specifically
exposed to them, notably Kurds and women with political
views considered inacceptable either to the government or
the army, points out Vanderlinden. Men aren't spared
maltreatment. At police stations they are victims of anal
rape or of having their testicles squashed.

To the aftereffects of the physiological and psychological
rape of women are added threats on their lives, threats of
renewed rapes, forced marriage or the ostracizing by their
families or their communities because of the experiences
they have gone through.

Amnesty thinks that the notion of "honour" serves as an
excuse for the authorities to stay inactive. It is very
difficult for women living in communities given to such
notions to report such violations because they are ashamed
and they are regarded as guilty simply because they revealed

complaint because they are convinced, and justly so, that in
most of the cases this won't help.

According to the information Amnesty received, women in
custody in turkish police stations are often denuded during
their interrogatons. In addition, the organisation remains
concerned because of the practice of the "virginity test"
inflicted on the detained women. To refuse to submit to it
can be interpreted as admitting one's "stained honour" and
increase the risk of renewed violations.

The discriminatory attitude of the representatives of the
State contribute to create a climate where violence against
women appears acceptable.

Thus, Amnesty International demands from the turkish
authorities to condemn

persons during interrogation, to prohibit the usage of
blindfolding women

international norms, to abolish the practice of forced
"virginity tests", to sentence the violators of fundamental
rights, to provide measures to guarantee the equality of men

entrer dans l'UE, la Turquie doit changer de mentalité ",
a-t-il dit, précisant que le pays compte 50.000 prisonniers
dont 10.000 prisonniers politiques.

Si les femmes de toute origine sociale et culturelle sont
susceptibles de subir de tels sévices, certains catégories
sont particulièrement exposées, notamment les Kurdes et
celles qui défendent des opinions politiques jugés
inacceptables par le gouvernement ou l'armée, indique Mme
Vanderlinden. Les hommes ne sont pas épargnés par ces
violences puisqu'ils sont victimes en garde à vue de viol
anal ou encore d'écrasement de leurs testicules.

Aux séquelles physiques et psychologiques du viol,
s'ajoutent pour les

sévices, du mariage forcé ou de l'ostracisme de leur famille
ou communauté en raison de ce qu'elles ont vécu.

Amnesty pense que la notion d' »honneur » sert d'excuse aux
autorités pour rester inactives. Il est très difficile pour
des femmes vivant dans des communautés attachées à cette
notion de dénoncer ces violences car elles sont honteuses et
on les regarde comme des coupables pour avoir simplement

D'après les renseignements obtenus par Amnesty, les femmes
en garde à vue dans les commissariats turcs sont fréquemment

l'organisation reste péoccupée par le recours au "test de
virginité " infligé aux femmes détenues. Le refus de s'y
soumettre peut être perçu comme l'aveu d'un "honneur
souillé" et accroître le risque de nouvelles violences.

Les attitudes discriminatoires que manifestent les
représentants de l'Etat contribuent à instaurer un climat
dans lequel la violence envers les femmes apparaît
acceptable.

Dès lors, Amnesty International appelle les autorités
turques à condamner

détenues au cours des interrogatoires, à interdire la
pratique consistant à bander les yeux des femmes placées en
garde à vue, à définir le viol et les

pratique des "tests de virginité" forcés, à traduire en
justice les auteurs de violations des droits fondamentaux, à
mettre en place des mesures garantissant l'égalité entre les
