Bought it this Friday (22nd) Took it home and rode it before it had gotten dark. The chain started rubbing against the front derailleur in 9th and 10th gear. SO im like ok whatever that can be adjusted easily, so I adjust it and I end up spending 2 hours trying to fix this problem, So I tell myself Screw this...its a new bike the bike shop needs to fix it. I take it over there and I tell them the problem, and they take it in and work on it for 15, they tell me its done. So I went out and tested it, and it still does it... so I take it back to them and tell them its still doing the same thing. They tell me to let them keep it over night so they can work on it a little more...so I let them do that...I come back the next day ..they tell me its done. I take it out in the parking lot again and test it... What do you know its still rubbing. They take it in again and work on it, and bring it back out to me, and said here try this I tested it out and it didnt really touch the front of the derailleur so I went ahead and took it home. So I get home to go biking and its starts to rub AGAIN. So im debating whether or not I should give them back the bike and get them to give me a new one or go to another bike store and get a trek 1000, they both feel good when I ride them..I just can’t decide =/
so Im asking for your opinions of what you would do in this situation.

Don't blame the bike. FD adjustment isn't rocket science...did you follow the drill at www.parktool.com (or similar) on adjusting it? Is the cage-vs-chain angle right in 9/10? With the above done correctly, you should be able to ride and make small (1/4 or less) tweaks on the limit and get it dialed in to zero/minimal rub in 10 without it dropping.

Assuming it's not the composite Giant OCR 3, then there are no 9th and 10th gears on back. It's an 8 speed cassette.
It is the shop's responsibility to fix the problem. It shouldn't be that difficult. Have you tried adjusting your trim?
Edit: Just looked the '05 non-composite OCR3 up on Giant's web site and it shows the shifters as being 8 speed Sora and the rear cassette as being a 9 speed SRAM. Both F & R Der are Sora. Looks like a typo on their part to me. Or they allow the use of either the large or small cog but not both.

sorry, you're right. (I ment rear 3rd front 3rd =9 and rear 5 front 2 =10) But yes I have adjusted Several things (trim as well), and have not succeeded, and as the former poster said its not rocket science but I have had 3-4 bike mechanics try to fix this as I have tried to fix this, mind you I am a former Mtb biker that has rode competitively for a while...I am not new to biking, I know what I am doing (most of the time :P) anyways
Now I'm confused... one thing to note -- slight rub can be normal, especially intermitent rub when you're pedaling hard and flexing the frame...although I've always been able to dial most of that out easily. As you mention it's rubbing in both of the largest cogs, I'm asusming you're talking about real problems here.
You should be able to completely dial out FD cage rub while in your largest cog fairly easily if the thing isn't damaged. While shifted to the smallest chainring, feel the cable, it should be fairly loose... if not adjust the barrel adjuster. Sight down the chain from the rear or front -- is the inner side of the cage approximately parallel to the chain/ring? If those are correct, adjust the Low limit screw until the rub is GONE! If you can't do that, sounds like something's been gimped. That's quite a bit nicer than the OCR 3 that is offered in the States. Since you've ridden MTB then you're obviously used to tripple chainrings up front. It shouldn't be that difficult for the mechanics to have adjusted that properly at least on the first 2 trys. Not sure what to suggest at this point. But it is their responsibility to get it right and not yours. It's your bike. You paid for it and it should be adjusted and working properly.
Would the same shop have another OCR 3 in stock that you could take out for a spin? If a second one didn't have the problem then perhaps they could swap them out for you. Maybe.
If they have some [censored] working there then I would definitely consider purchasing (or at least having any maintenance done) at another shop.
Obviously your LBS didn't take the Bike out for a test ride after making the adjustments, are you cross chaining too much?
My Cannondale CAAD4 R400 with Tiagra/Sora changes as smooth and acurately as my Six13 Record and it's only been tuned up once in just over 3000 miles...pretty amazing if you ask me!!
You CAN NOT be in the small or middle chain ring and be on the 8th or 9th cog on the back. Your forcing the chain to bend undesirably.
Forgetting about the granny gear, you can only use cogs 1-6/7 for the middle chain ring...and cogs 5/6-9 for the large ring. You can adjust the deraileurs all you want, but you will not be able to avoid this.
Keep this in mind when your shifting...Im surprised your LBS didnt tell you this.
