There was a Federal District Court decision that applied to a limited
number of states and limited dosages. Here's part of the article from

A Utah Federal District Court recently limited the scope of a year old
Food and Drug Administration’s (FDA) Final Rule banning the sale of
all ephedrine-alkaloid dietary supplements. The Court’s ruling has a
limited affect on the ability of companies to sell ephedrine
nationally, but is important regarding FDA procedure for creating
rules and enforcement powers. Ephedrine alkaloids are found primarily
in the controversial herb ephedra (Ephedra sincica Stapf.,
Ephedraceae).

This ruling has limited effects at the moment since the FDA may appeal
this decision. Additionally, the ruling has no effect on the laws of
several states (including California, Illinois and New York) which
have banned all sales of ephedrine alkaloids in dietary supplements.
The ruling also only applies to products containing 10 mg or less of
ephedrine alkaloids per daily dosage. Any product exceeding that
amount is still banned and will continue to be enforced under the FDA
rule.

So - even if you live in one of the areas under the jusidiction of
that Circuit court, from your description of your intended selling
method is certainly sounds like you intended to market it outside
those areas. Perhaps you'd like to tell me how you would have
screened me out as a customer? I live in CA. And by the way - just
what sort of dosage were you selling?

The fact that some other people choose to break the law does not mean
that it is right for you to do so. There are a lot of laws where
enforcement is lax and people choose to ignore those laws. But
whether or not YOU wish to take that risk, that doesn't mean that you
get to force OTHERS to take that risk. Your ad campaign would have
made others into accomplices, so it is quite reasonable that they
declined to participate.
