I hope not because he will not be able to claim his solicitor's costs if
he wins and is. OTOH they can't claim theirs if they win but small
claims is easy enough to do by yourself (and the costs rules are
designed to encourage it)

Unlikely since the small claims limit for personal injury cases is only
£1,000. I'm sure Not Responding is looking for more than that.

As to what happens next - negotiations will continue. They can continue
right up to the hearing. Insurers play a game of brinkmanship designed to
deter claimants and keep their payouts down. Issuing proceedings is just
one step in the process. A necessary step, if you're not getting anywhere
before doing so, showing that you're not going to just give up and go away.

And very often they will offer to do a deal on the steps of the court.
