  1. I ordered some bike gear from Rose, not for the first time, and after an
eventual wait, called them to query where my items have gone to. To cut
a long story short, DHL claim that they made a delivery with a neighbor
called "RAYMOND" at no. 7 across the road. They NEVER left a card at my
address to let me know of this. The delivery driver claims an old man at
no. 7 said "yeah I'll take their delivery, I know them well". No one
knows us well, we have only been there since Sept. last year.

Needless to say, there is no "Raymond" nor any bike gear at no. 7. Apart
from a lady who has been polite enough to be patient with me as I query
    her about my delivery.

Where can I go from here?

First up, try asking a few more neighbours. It might not have been no. 7.

If that fails, you need to tell Rose that it's not been delivered. It's
    their problem.

The situation is simple. You purchased an item that you haven't
received. You honoured your side of the agreement (contract) by
making payment, they now need to honour their side of the agreement
    (contract) by providing the goods.

Simply advise them that you haven't received the goods and ask them to
send the goods or return your money.

Contact me if I can be of any help -

  4. DHL Should have a sinature/proof of delivery. If they can't prove they delivered then you may have a claim for your missing stuff. And check DHL went to the right street, I've had stuff delivered to the same street name but wrong postcode.

    1) Report to DHL non-delivery, ask them to find and deliver your goods.
    2) Report to Rose non-delivery, ask them to refund or resend the goods.
    3) If paid by Credit Card, (and technically if over £100), report to credit
card issuer that you have potential dispute, and may need to invoke Consumer
    Credit Act.

Wait approx 2 weeks for (1) or (2) to provide adequate explanation and
    corrective actions.

    Then
    4) Tell Credit Card company you are invoking Consumer Credit Act over
non-delivery of goods. They may bluster, but stick to guns, and they must
to re-fund you. Rose and Credit Card company can now fight over the
    money/goods.

    5) Go shopping again with your money returned.

Who's the spammer? Somebody who posts a helpful response to a question, or
someone who posts an empty accusation with a link to their own [censored] website?

Well, which is more likely? Somebody who is a regular and well-known
u.r.c poster, or someone with no previous posting history (according to
Google Groups, at least) and whose company has previously sent spam to
    usenet

I asked a few more people round where I live, no one has a package in my
name. It is likely the DHL driver is an idiot (he went to a totally
different address) or dishonest (kept package for himself). I will have
to follow it up with Rose.

    Thanks. I have already done 1 & 2, but as I paid by debit card, I don't
    think 3, 4 & 5 apply to me.
    Thanks for the info nonetheless.

Paul Brown's post was neither bulk or unsolicited. It was on topic and
answered a specific question. i.e. It is NOT spam.

Only a [censored] would think it is. - Do you think it's spam?

There is no hard evidence that this sighting was from Paul Brown's company.
I would hazzard a guess that Paul Brown's email has been harvested by a
spammer. That's why I use mailinator.

    Read this before you answer:
    http://en.wikipedia.org/wiki/Newsgroup_spam

"Usenet convention defines spamming as excessive multiple posting, that is,
the repeated posting of a message (or substantially similar messages). "

Correct, legally a Debit Card isn't the same as Credit Card. In future
purchase things online with a Credit Card.

May still be worth trying your bank as it could be taken as a type of
internet fraud (you ordered goods and they were not delivered, yet you were
billed for them). It depends on your bank.

By the Breidbart Index, no. By the colloquial definition (which
basically equates to off-topic advertising) it could be seen as such.
Especially when undertaken by someone with no previous posting record
and then backed up by someone else using a throwaway account who feels
the need to attack a regular and useful newsgroup contributor. Have you
been reading this group long? Why so rude? What are you hoping to achieve?

I hope you'll admit that Luke's post was not spam by either definition.

  16. Having the name is not the same as pod. They should be able to show you a signature. The onus is on DHL/Rose to prove they delivered not on you to prove they did not. Worth taking the details to CAB/Local Consumer group/ even trading standards.

It was not off topic and the inclustion of his email address (to offer more
advice) was not advertising. - If you look at the domain of his email
address, it is for *business* to *business* debt collection, perhaps in a
position to offer advice? - Are you advertising Telent?

It was not a personal attack, I was attacking the ad hominem on Paul Brown.

    Long enough.

Only being reflective of the attitude directed at new posters by the
existing so called "regular and useful newsgroup contributors".

To point out that it is wrong to accuse a *new* poster as spamming, when all
he did was post useful information and his email offering more help. -
Surely it would be better to welcome new posters, especially when it is
    clear that they are 'contributing'?

If you can find so much as one link on that site that earns me or anyone
to whom I am affiliated any money then you might be justified in calling
    me a spammer.

I have not accused anyone of being a spammer. You may have inferred an
accusation. I may even have implied it. My post, simply, should have
been seen as a challenge to the PP to show that he is not a spammer.
When he replies on this group, he may even give us evidence to suggest
as much. I hope that he does.

I'm sorry my site is not to your liking. I'll not lose sleep over it
however. The title of the site should have been enough for you to guess
that it was of no interest to you. Welcome, by the way, to urc.

    Cheers,
