Cyclist assaulted in Sheffield

  1. Long-term subscribers to this list may recall the case in December 2005
    where a cyclist was assaulted in Sheffield. The victim reported the case
    via the CTC forum when looking for advice as to how to proceed, and it
    got forwarded amongst the various cycling fora. A number of posters on
    this list suggested that this incident did not ring true and must have
    been made up.

    The case has now come to court and was reported in the Sheffield Star
    on April 27th. A scan is available at

    and back issues are available from the Star offices at
    York Street, Sheffield, S1 1PU, 0114 276 7676

    I trust therefore that the posters who alleged that this story had been
    fabricated will now recognise that they were wrong and apologise for the
    distress they have caused to the victim, his family and friends.

    I'm a little shocked that such a deliberate assult didn't get
    a custodial scentence.

  3. I don't understand why the sentence was so lenient. The guy is clearly a nutjob
    and should've been locked up either in prison for 6 months-1 year or put in a
    mental institution

    As for keeping his driving licence - if he'd have threatened someone with a
    gun he wouldn't be keeping his firearms licence.

    All I can think of is that he made it clear he was terribly middle class
    and wouldn't do it again.

    I remember it being brought up, I remember thinking that it sounded
    incredible. I've just had a quick re-read of the original thread, and yes
    there were one or two who voiced an opinion of whether this was fact or
    fiction. Then someone posted that he knew the bloke and correlated the
    story.

    The whole point was this story did sound *incredible*. (Definition: So
    implausible as to elicit disbelief).

    It was a terrible incident, and my best wishes to Andrew. The courts
    decision was insulting based on the crime. I'm not really sure how these
    weekly payments are to be made, but the victim will now have to have some
    sort of contact with the *criminal* for the next five years. Disgraceful.

    So, having deliberately used first a motor vehicle and then a wheelbrace
    as weapons, the assailant walked free? What do you have to do to get
    jailed in this country these days?

    This is a shocking case and it appears to me that
    the sentence (and in fact the charges brought) are
    out of line with the goal of the perpretator.

    I was recently deliberately (it would appear)
    struck by a car while crossing the road through
    a previously stationary traffic queue that moved off.

    The long and short of it is that I have been charged
    with Criminal Damage since the car was damaged
    as I escaped from underneath it. It does not appear
    as if any consideration was given to charging
    the driver.

    That a deliberate attack with a motor vehicle is
    not regarded as attempted murder is quite
    beyond my understanding. It is not as if there is
    not enough evidence that people struck by cars
    are likely to die.

    In the case in Sheffield the attack was begun
    with the car and was then continued with other weapons.
    How can there be any doubt that the intent was to
    cause harm and that the harm likely to be caused
    was death.

    I understand that an attack with a gun is inevitably
    attempted murder. That an attack with a car is
    regarded not as an assault but as a driving fault
    is beyond my understanding.

    Independently of my recent difficulty I had alerady stopped
    cycling on the road and stopped motor-scootering too
    due to the level of harrassment meeted out by
    the drivers of larger vehicles. In Central London
    it amounts to pretty much never feeling safe.

    300 years ago, 90+% of all the land in Britain was common. Now, probably
    less than 5% is. 85% of the common land has been more or less stolen; in
    some places absolutely stolen, in others stolen with the aid of acts of
    a parliament in which the common people were wholly unrepresented. And
    the successors of the thieves now not only still have the land, not only
    pay no taxes on the land, they are paid socking big subsidies out of
    your taxes and mine to sit on their fat fannies and buy a new Mercedes
    every year.

    The French would have a a revolution about this; we just grumble.

    If he'd waited until the minipikey was outside and run him down with a

    It was worse than that. My recollection is that Mr Martin did not
    shoot the thief dead. Rather he wounded the thief, who later bled to
    death near the house. It is possible that had Mr Martin contacted
    the police immediately the thief could have been taken to hospital
    and survived. Instead Mr Martin went off to dispose of his illegal
    and illegally held gun.

    Some might argue that thieves deserve everything they get, but
    allowing people to wound those they think are thieves and leave them
    to bleed to death is hardly the mark of a rounded society.

    A deliberate assault using not just one but two weapons and
    threatening words. Attempted murder by the sound of it.

    "Get the white [censored]" sounds like a racial aggravating factor as
    well, which the courts are supposed to take into account when
    sentencing. Perhaps the Hutton did take it into account and this is
    a "more severe" than he would usually impose.
