I recently purchased a New Road bike from EBAY which was put up for auction by a bike company. The Bike was advertised as having qoute '' Groupset: Campagnola Mirage'' Sounded good to me especially re the price I paid for it. Problem being that when it arrived he chainset and brakes were not Campag Mirage with the chainset being non branded and brakes unknown make to me. The rest was campag: wheels,gear/brake shifter,rear mech,front mech etc.I feel that I have been misled and the the qoute indicated a full groupset. The company has refused to take back the bike or compensate although they have admitted that there description was flawed. They did offer to upgrade the chainset to Mirage but would charge me the diference from cost of present chainset to mirage around £16 in their view.It is more the principle thay annoys me,not the extra £16, (being misled) and I probably would not have purchased bike if had known the above. They would not upgrade for nothing.In the end the quality is not as described in advert They have written me a letter to say that if I wanted to take it further I would need to involve a solicitor.
Do you think I am being picky?. Anyone think I have a case? and should take them on?
If you purchased on EBay I think you can take it up with them. They take a very dim view of misleading advertising. If it is a company then you should also check with your Office of Consumer Affairs - I'm assuming there is something like that in Britain. In my view you should have been delivered what you paid for.
I'd check with a lawyer as well - under common law you have entered into a contract when you put in the bid. The company that supplied you have not honoured the contract by supplying you with something different from what you purchased.
They haven't got a leg to stand on - don't let them get away with it.
lol i picked it up for free from somwhere, i had one previously and loveed riding it and i think it ended up in the wrong thread too, was sposed to go into the "show me your road bike" thread =\ dunno how i muffed that up 🙂
