    Right on Boyd. Have these people never heard of 'psyching' an opponent or
    smack talking in a race. Now admittedly, Simeoni is not even at Lance's
    level, but we all know the Badger (Hinault), the Cannibal (Merckx) and the
    Machine (Indurain) took it upon themselves to rule the peloton - why not
    Lance? For me it's exciting racing. What the hell - It's not like Lance
    whacked Simeoni with his Zephal?

    While I'm at it what should we call Lance? Possibilities abound. 'The
    Cojhones de Toro", "the total Package", "the Phenom"? <g>

    I kid, but yeah, it's so st00pid for the Italians to be bothered by this
    crapola.

    The defamation of character suit is merited in my opinion. Simeoni
    testified against Ferrari under oath in normal court proceedings and
    Armstrong shouldn't have said anything about it, especially considering
    his own interests in the Ferrari trial. When he did, it was big news,
    because everything he says or does is big news. His celebrity status
    both in- and outside the cycling world gives his words weight. 99% Of
    Americans and 50% of Europeans who previously had no opinion on Simeoni
    or even knew who he was, now think he is a whining loser.

    Intimidation of the witness, I don't know. As I said, I think it was
    very childish of Armstrong and US Postal to act that way, and in
    non-judicial terms it was definitely related to the Simeoni lawsuit, but
    I can't see how it can be made to stick in court. Except maybe if their
    fellow escapees from that incident where Simeoni and Armstrong both went
    back to the peloton, have testified/declared that they heard LA say
    things to FS that (again) he shouldn't have said.

    As I recall, Simeoni also accused Armstrong of saying things like 'I am
    going to break you'. If that is true, then that really is intimidation of a
    witness and such remarks deserve more investigation than Armstrong chasing
    during the race. If I were a witness in a regular court case, I'd certainly
    report such a thing and would not be surprised if the police looked into it.
    I don't think the Italian police are particularly after Armstrong, but
    rather that the suspected offense is serious enough.

    I respect you highly ED, but I think this is all over-hyped, just boys
    being boys, charged up and sometimes childish. I think the WADA needs to
    get out of the drug testing biz and let that all be in the legal domain.
    We're always gonna have doping. Make it less attractive within cycling,
    sure, but let the cops handle it.

    That's just my opinion. In fact some of my opinions on this are not
    -strong- opinions.

    This is valid. But should we not separate someone just blurting out 'I'm
    gonna kick your sorry ass', and someone saying "I'm going to destroy you in
    every way and your cycling career too" and then having that person actually
    -do- a destructive thing. As long as it's just guys smack talking leave it
    alone. A says that to S on the phone, S says 'Fsk off, loser', and then A
    does nothing else - doesn't start making calls behind the scenes, etc. I
    really don't see LA as a person who would actually try to 'break someone',
    like being Elvis of Austin with a texas mafia. Do you.

    OTOH, I see the need for the law to protect those who threaten people using
    the phone system and soforth.

    Just out of curiosity Brian, exactly what is wrong with you? You most
    certainly have demonstrated beyond the call of duty the definition of
    the term "horse's ass".

  12. Ed, if I might criticize your posting a bit:

    Simeoni apparently DID say that Dr. Ferrari "prescribed" dope. But of
    course he didn't have any prescription from the good doctor. What he
    seems to have meant is that Dr. Ferrari described to him the actions of
    various drugs and he took that to mean that the doctor was telling him
    to use drugs. I think that you've read enough of Dr. Ferrari's writings
    here and there to realize that the man is a hell of a lot more
    complicated than some Belgian veterinarian.

    Also, I believe that there must be a great deal more than this incident
    since most of the peloton was behind Lance all the way. After all, the
    peloton didn't respond when Lance chased Simeoni down and got a good
    gap. That says a great deal.

    As for Paolo Bettini - I don't believe that he was "supporting" Simeoni
    in the regard that you seem to imply. I think that Paolo offered
    Simeoni friendship when he needed it. I think that is a hell of a lot
    more positive for Paolo than for Simeoni.

    That is what I meant. Or at least, nothing more can be deduced from what
    we know. But together with the escapers, Bettini _was_ asked to make a
    statement. That may imply that (the police thought that) his loyalties
    go a little further than just friendship without regard for the case.

    The magistrate who conducted Ferrari's trial found Simeoni's testimony
    credible and along with other proof adduced at trial, convicted Ferrari on
    more than one criminal count.

    Armstrong was quoted from an interview in the a French paper in which he
    called Simeoni a liar. To the best of my knowledge, Armstrong has never
    disputed the accuracy of the report nor has he retracted the charge that
    Simeoni lied in his testimony under oath.

    By intimidating one witness in a jucicial proceeding, he may have
    intimidated others in the peloton from coming forward with information on
    doping in the peloton and crimes related to that. Witness intimidation is a
    crime in all juristictions in the US and EC.

    I should add that intent to intimidate other witnesses would have to be
    proven for a conviction. Thus the need for testimony from others in the
    peloton.

    Witness Intimidation involves threatening a witness or potential
    witness. What evidence is there of Lance intimidating a cowering, lying
    Simeoni?
