  1. I can exclusively reveal that 'Alan Holmes' is actually a pseudonym used by
    judge Peter Openshaw:

Strewth! Surely that judge isn't competent to make a judgement in that
    particular case!

indeed, should be removed fairly promtly.

    I think we'll find that he's a fast learner.

    Why?

Firstly, he may have been asking because he thought that some on the
    jury might not know.

Secondly, what exactly is a web-site in law? Is it just defined as HTML
delivered over HTTP? To be honest if the law was written correctly it
wouldn't matter. But the govt. have tended to treat electronic
communication over the internet as a specific offence rather than use
the existing legislation - or at least that has been their rhetoric, and
the media have supported them every step of the way. So I wouldn't be
surprised if there was a specific clause in the law with differential
    punishment.

the news item doesn't seem to bare that idea out, it *looks* like the
judge has very little idea as to the what and the hows of the case which
in some cases would be not a issue but not in this case.

on the other hand this looks like tabloid news so who knows.
