BOZEMAN - Attorneys for a group of investors who sued the exclusive
Yellowstone Club near Big Sky are accusing the club of stalling in
providing them financial records.
In court documents made public Monday, lawyers for the plaintiffs,
including champion cyclist Greg LeMond, his in-laws and a friend, are
asking a judge to order the defendants' attorneys to provide records
they contend they are entitled to see through the legal "discovery"
process.
They also are seeking an order requiring the release of financial
records from other companies that Tim Blixseth, the Yellowstone Club
developer, is involved in, alleging that the "limited" records they've
been provided so far have "begun to show evidence of a massive scheme
to misappropriate assets."
Clifford Edwards, a Billings attorney representing the club, declined
to comment at length Monday, saying the defendants had chosen "not to
try this case in the newspaper."
However, he said the Yellowstone Club and Blixseth already have
provided "tens of thousands of pages" of documents, but will continue
to object to efforts by the plaintiffs to turn over certain financial
records.
"We will assert our objections as we are entitled to do under Montana
law," he said. "Their demands are without respect to anyone else's
privacy."
The Yellowstone Club is a private, gated community south of Big Sky
where members must prove they're worth at least $3 million to join.
Houses sell for $10 million and up, and building sites cost $1 million
an acre. The club also includes a private ski hill, golf course and
other amenities.
