he was taken to hospital and saved.

harm, and one count of leaving the scene of an accident." It didn't go to a jury.

I would be inclined to agree with you on this one - I am not in favour of hanging but castration
does have a certain appeal.

Apparenty this is what happened:

"Have read with interest the article and comment (Mail, April 22) about the road rage case of Carl
Baxter. I think I should point out a number of inaccuracies in the two articles.

Carl Baxter was convicted of a total of four offences arising from his driving on Sunday, June 23.

These were dangerous driving, two offences of unlawfully causing grievous bodily harm to Emily and
Stephen Kirwin, and failing to stop at the scene of the accident.

The maximum sentences for these offences are five years' imprisonment for the assaults, two years
for dangerous driving and six months for failing to stop at the scene.

The decision to pursue the assault charges was taken by the Crown Prosecution Service in order to
allow the court additional sentencing options over and above the two years for dangerous driving.

This robust approach was taken in light of the fact that the defence was likely to argue that the
assault charges duplicated the driving offence.

This is what happened when, on February 4, the defence argued that the assault charges were an abuse
of process.

This argument was rejected by the judge who accepted the Crown's view that they were separate and
aggravating features of dangerous driving.

At this point, the defendant pleaded guilty to the assault charges, having previously admitted the
offence of dangerous driving.

The sentence that he received was in fact 15 months' imprisonment for dangerous driving and two
years for the two assaults, each running concurrently, making a total of two years."

I don't understand this 'concurrency' stuff. Two plus two plus 15 months equals five years three
months. Not Two, with time off for good behaviour - the only thing off should be his goolies.

How does a 'concurrent' sentence work? Surely it would be more punishment to keep him in jail for
once sentence after the other than for both at once? Sorts of defeats the purpose methinks. Maybe
that's why I'm not a lawyer though.

Ah, but read the article closely...

The revocation of his operators licence will expire just before he gets his driving licence back.
Ie. no extra penalty has been added and in any case the company is now operating under another
licence in his fathers name...

I sent the following to the Hull Daily Mail about this. I wonder if they will print it...

It is difficult to see how the temporary revocation of the operators license of haulage firm Brian
Baxter and Son can be considered to be any form of punishment. First Hull Crown Court made it clear
that it does not consider the the use of a 2 tonne Range Rover as a weapon to be a serious matter
when it imposed a relatively short jail sentence, and more importantly only a derisory 2 year
driving ban on Carl Baxter after he deliberately ran down cyclist Stephen Kirwin and his 4 year old
daughter. Now this disgraceful display of British 'justice' has been compounded by the imposition of
a meaningless license revocation, thoughtfully timed to expire a soon as Carl Baxter's short driving
ban also expires. It is little wonder that so many drivers feel free to take liberties with the
safety of cyclists and other vulnerable road users when even behaviour as extreme as that of Carl
Baxter is all but condoned by the Courts and Government agencies.
