  1. They're sticking to their guns. I'm just glad that that £200 I've spent in
    the last month wasn't in their store.

    Hardly worth wasting a court's time over a broken £20 rack. I'm sure that's
    what they are betting on, and they're right. I'm sure the courts have better
    things to worry about.

    Anyway, just be sure they will never get my service again.

    Well, they first said that their policy is no receipt, no deal. Not sure how
    their policy is above the law as it clearly states that no receipt is
    neccesary. They say that "it wasn't on the shops computer". Well, as they
    archive everything after a year, this is inot surprising. The fact that they
    haven't gone through their head office records, shows their total
    indifference to my complaint and my business.

    They then state that the rack was fitted incorrectly, i.e. on inside of
    frame. I certainly didn't get any detailed fitting instructions when I
    bought it and as the fittings are bi-directional ... they ought to make this
    clear with every rack they sell in the future if this is the case. Anyway,
    am not really sure how this would cause a catostrophic failure of said item.

    All in all, they seem to be just countering anything and everything to cover
    their backs.

    Have you dealt with their head office or a twit in the shop? IME head
    office tends to sort things out especially if one writes or telephones
    the managing director type persons. Did this when a car company failed
    to secure the wheel bearings on my car, hence wheel came adrift -
    almost, held on by spit and the hubcap. Manager of offending shop, who
    had not been at all helpful when I rang was made to come out to us, hand
    over his company car, arrange collection of our vehicle, repair it and
    have it delivered back to us with a full refund.
    Place closed down shortly after.

    Dealt with the MD of Evans and everyone in the chain of command.

    MoneyClaim Online. You can start the process of a small claims court
    claim on-line, each party pays their own costs but the winning party can
    claim the cost of filing the claim (but not the time and effort involved
    or any professional fees). I would think they would settle pretty
    quickly once the process started as the cost to them will be
    disproportionate. You may want to precede it with a letter telling them
    that's what you will be doing if they don't settle.
