Our morning show includes a good deal of animated banter, between callers and on-air
personalities, that can be both humorous and caustic. The intention is always to entertain our
listeners. During a couple of shows this week, time was spent by callers and on-air personalities
discussing driving and cyclists. During this discussion, comments were made which at the time we
felt were humorous in nature. In retrospect we feel that the some of the comments were
inappropriate, and for that we sincerely apologize.

I noticed that there is a petitiion to the FCC to deny about 60 Clear Channel stations renewal of
their licenses. Perhaps "inciting manslaughter" should be added to the reasons. Anyone care to write
to essential.org to inform them of this latest instance of Clear Channel's disgraceful behavior? Or
maybe Ken Spitzer would be more responsive if his station was added to the petition.

In general, one who commands, directs, advises, encourages, procures, instigates, promotes,
controls, aids or abets a wrongful act by another is considered as responsible as the person who
physically committed the act. The Federal Circuit Court for the District of Columbia considered
the case of Linda Hamilton, the live-in companion of Bernard Welch. Welch was a career burglar
who, during one of his robberies, killed a man. Although Hamilton participated in none of her
paramour's crimes, she lived off the proceeds of his burglaries and encouraged his activities. The
family of the murdered man sued her, and won. The Court reasoned that:"

the media outlet must be generally aware of their role as part of an overall illegal or
tortuous activity at the time that they provides the assistance; (3) the media outlet must
knowingly and substantially assist the principal violation.

I think that a strong argument could be made that activities of the type carried on at the
Raleigh, Houston, and Cleveland radio stations could meet this test, especially considering that
one company owns the stations in all three markets."
