Across the road from me is a building site. I look down on it,
due to being on a hill.
Prominent "hard hat area" signs at the entry to the site, of course.
And until recently, workmen seen wearing hard hats most of the time.
Yesterday afternoon they were laying bricks in the wall.
Warm sunshine, and not a hat in sight.
This morning - huge crane lifting more kit up to the workmen -
possible hazard. A quick glance out showed two hard hats,
two bare heads, and one baseball cap. That's just the ones
I can easily see - and therefore excludes the drivers of the
crane and of a lorry, and possibly others.
Other case: backstage hard hat areas, which are sometimes
ignored, in defiance of insewerants. We were performing
(Verdi's version of) a certain Scottish play when someone
did hurt his head badly enough to need a hospital visit,
but he was outside the designated hard hat area at the time!
So, where's the case law when Bad Things happen in a hard
hat area?
