I sincerely hope he's going to be ok too. For him, his family & friends as well.

Not many details in the article - also check there's a later update from the police:

3. This was on the 10pm ABC news, the Major Collision Investigation Group is now involved. A dark coloured 4WD heading south hit another car, which then hit the cyclist.

4. I rode past at about 8pm, and traffic was diverted. It seemed to be close to the Beauey Pub, and, as anyone who rides past there regularly would know, the short section right outside the pub is a kinda dangerous. The road gets very narrow and riders are suddenly confronted with parked cars and the occasional opening car door. 🙁 I often slow right down through that section, and sometimes, if it's busy, I take back streets from Balcombe Rd to Charman.

I got a miscelaneous missile thrown at me tonight by a bunch of yahoos
in a white car on the Maroondah Hwy tonight while riding home, and a
friend and I were nearly cleaned up by a woman in a blue something
deciding to go through a roundabout that we were already on and
occupying quite visably. Also, when we were doing boglaps of the
Hawthawn smellodrone tonight some bunch of triwobbletes were swerving
all over the place, and sure enough, one of the unfortunates must have
hit a wheel or something and came down, middle-aged woman, looked like
a decent sprain or a broken wrist. Hope she's ok.

Must have been a day for it.

Bloody place is full of triwobblers at the moment, my favorite training
venues are full of blokes in bikinis weaving all over the road,
grinding 60rpm and showing off their beer guts between their bathers
and that funny tri-t thing they all wear. I predict more crashes ...
:-/

Good news is I'm on target for 1,000km in a week. In fact, am 20km up
at the moment! Only 3 days to go, and still got 480km to ride. It'll
be a long weekend in the saddle 🙂

6. I had a wierd one on way home last night; luckily nobody hurt (apart from one guy's ego...)
Incident caught on phone/video too apparently. gonna try getting copy...

Could well have been this:

Either the car or the 4WD grievously screwed up. Here's hoping the cyclist
recovers.

I had a vibe like that, and given that I was incredibly tired and
planning on getting up early to run, I decided to catch a bus home and
leave my bike at uni. I didn't feature trying my luck with peak-hour
traffic and only half my usual concentration span.

Speculation time...I reckon the guy in the Prado was in the left lane ducking and weaving along that straight before the Florist at Keys St, suddenly confronted by parked cars and road narrowing signs and squirts it hard, gap is two small, swipes the other car, loses it , crosses the road and biffo to our cyclist....
Must have been hooning as just about every cyclist heading north at this point is in the gutter, its a narrow stretch and even though the northern heading is two lanes its a natural to be far left at this point...

bad enough hitting one rider, and it would have been mega grossly horrible head on into a car/truck/bus/cop car etc or bunch riders...Just plain Yuck!

So the high police interest is very positive..hope they catch the moron and toss him off the Beau-y pub cliff ...give the gulls some carrion to feed on!

Mine...mine...mine, mineminemine....nah splat on the dude and let him rot!

It seems most cyclist injuries / deaths lately have been collisions with 4WDs, or is that my imagination?
Has anyone done the statistics, % 4WD incidents vs % 4WD on the road.

675km so far, only 325 to go. 200 tomorrow, the rest on Sunday.

mmm, *big* k's 🙂

I may be a fat, lazy sprinter who's the slowest slug up a hill, but
this winter I intend to win the flat races!

Excellent news! That they actually got the person, well hopefully they have, and that the guy is stable and will make a recovery. Thanks for the update!

I wonder, under what circumstances are people released from custody
after very nearly committing a homicide?

probably similar to how apparently you can hijack a truck full of alcohol, kidnap a person, armed with weapons and still be released on bail.......

just great....

Under what circumstances should people be locked up without enough evidence to lay a charge?

really... we don't know much more than we did some days ago...

Jurisdictions may vary, but generally, there is a presumption that a charged person will be released from custody while awaiting a court hearing provided they meet certain criteria. There is a presumption that the person will be released for minor offences. There is generally a presumption against release for murder charges and certain serious drugs charges. In the ACT, for example, the criteria are set out in s22 of the Bail Act:

22 Criteria for granting bail to adults

(1) In making a decision about the grant of bail to an adult in relation to an offence, a court or authorised officer must consider—

(a) the likelihood of the person appearing in court in relation to the offence; and

(b) the likelihood of the person, while released on bail—

(i) committing an offence; or

(ii) harassing or endangering the safety or welfare of anyone; or

(iii) interfering with evidence, intimidating a witness, or otherwise obstructing the course of justice, in relation to the person or anyone else; and

(c) the interests of the person.

Examples for paragraph (c)
1 the need of the person for physical protection

2 the period that the person may be held in custody if bail is refused and the conditions under which the person would be held

Note An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see Legislation Act, s 126 and s 132).

(2) Also, if the person is convicted of an indictable offence, or the elements of an indictable offence are proven in relation to the person, but the person has not been sentenced, a court must consider the likelihood of the person being given a sentence of imprisonment.

(3) In considering the matters mentioned in subsection (1) or (2), the court or authorised officer may have regard to any relevant matter, including—

(a) the nature and seriousness of the offence; or

(b) the person’s character, background and community ties; or

(c) the likely effect of a refusal of bail on the person’s family or dependants; or

(d) any previous grants of bail to the person; or

(e) the strength of the evidence against the person.

Example

In considering under subsection (1) the likelihood of the person appearing in court in relation to the offence, the court or authorised officer may have regard to whether the person failed to comply with a bail condition previously.

In practice, reasons put forward in bail applications in court include that the person is not likely to re-offend, is not a threat to witnesses, has strong links to the community and is not a flight risk, has family commitments, is in stable employment, is not likely to further injure the victim, etc.

An ordinary average person who has injured someone on the road and has been charged with something like dangerous/culpable driving will generally get bail. If the facts disclose attampted murder (ie the driver INTENDED to kill the injured person), it would be less likely that bail would be granted.

Note that courts will be reluctant to grant bail where they believe there is a lynch mob waiting for the accused.

When the cops lack evidence adequate for an arrest of course.
They dont want to arrest him and have to release him cos it makes the
case more difficult should it go to trial. They can;t arrest him
without a reasonable case... well not once a judge gets a look at the
evidence.

And they grabbed the car.

So reading between the lines. (And its just conjecture) THey rekon they
have the right guy. They think forensics on the car will make the case.
THey asked a judge for a warrent to seize the car. They got it.. so
he thinks it will make or break the case as well. And when they get
the lab report back.. they will go and make an arrest. Take
statements.. put the case together and hand it to the prosecuter.
After that its not up to the cops
