Dear Texas voters, Next Saturday, you have the opportunity to vote on Proposition 12. It is critical
that you get out and vote. The problem with Proposition 12 is that is opens the door for not only
medical malpractice lawsuits but any other kind of lawsuit to have a cap of $250,000 on "non-
economic" damages. Many years ago I became severely ill because of a situation at my job. Because my
total cap for damages was set at $250,000, no high-powered attorney would take my case because he or
she couldn't afford to. We do not live in a world where attorneys put mortgages on their homes to
represent us as we saw in the movie called A Civil Action. In case you don't know, personal injury
lawsuits are very expensive to try. In my case, it was once estimated to cost $100,000 to $300,000
to get my case to the courtroom, so obviously good attorneys did not make devastating financial
decisions in my behalf. If I had been in their shoes, I wouldn't have deliberately chosen to lose
money on a case either. I also don't have any issues with the medical community. No doctor, nurse,
or hospital has harmed me in the past 13 years of my being ill. Some of them have been more than
kind and compassionate beyond measure. A few of them have helped to save my life. What I want to
share with you is what I lost by being associated with a system with a $250,000 cap on damages. I
lost the incredibly good health that I used to take for granted thirteen years ago. I lost the
chance to complete my doctorate because I became too ill to finish it. I lost my primary source of
income. I lost my chance to tell the truth in a court of law. I lost my chance to have a regular
social life, eat normal food, buy a new car more than once every sixteen years, and be self
sufficient financially and physically at times. I also lost some friends because not everyone can
deal with someone who is chronically ill for years or decades on end. I did not lose my life by the
grace and mercy of God, but I lost almost everything else. If I can lose so much in a world of
$250,000 caps on damages, then so can you. Next Saturday, September 13, I hope and pray that you
will join me in voting NO to Proposition 12 because if you do not, you will be giving away for all
Texans including you the chance to have a fair day in the courtroom where justice is determined by
judges and/or a jury of every day people like you and me, not by the legislature. You may not be
able to conceive of you or your loved ones being harmed catastrophically by someone else, but if it
can happen to me, it can happen to you or someone whom you love as well. Please do the right thing
and protect the rights of all Texans by voting NO to Proposition
