If your vehicle is not roadworthy, that does not give you the right to
use it on the pavement. Rather, you should keep it off of the public
highway completely until it has been made roadworthy.

No it didn't, ever. It says, and always (as far as I can recall) has,
"you MUST NOT cycle on the pavement", which is rather different. Rule
54.

No, if you don't have lights at night you're not allowed to ride AT ALL.
Get lights.

You're never safer if you ride on the pavement. Riding on the pavement is
between 1.2 and 6 times /more/ /dangerous/ than riding on the road,
depending on a number of factors.
