    Woman Gets Detention Over E-Mail Interception

    POSTED: 8:57 a.m. MDT October 19, 2003

    DENVER -- A 28-year-old woman has been sentenced to 60 days home
    detention for intercepting the e-mail of the ex-wife of her husband.

    U.S. District Judge Richard P. Matsch imposed the sentence on Angel
    Lee, saying he intended it to be a warning to other people who might
    be tempted to intercept someone else's e-mails.

    It is believed to be the first prosecution in federal court in
    Colorado for intercepting another person's e-mails.

    Lee admitted accessing at least 215 e-mails during two months last
    year that belonged to Duongladde Ramsay, the ex-wife of Lee's husband,
    Jeffrey.

    In a previous court proceeding, Matsch described the case as ''a
    vicious, mean-spirited (divorce) dispute about children.'' On Friday,
    Matsch told Lee he had considered sending her to jail, but that she
    needs to be at home to care for her young children.

    ''But this was a malicious act,'' the judge said. Matsch said he was
    sentencing Lee to detention to send a message ''that you committed a
    serious crime and you're being punished for it.''

    Lee and her husband live in El Mirage, Ariz. She fraudulently obtained
    confidential user name and password information for Ramsay's e-mail
    account.

    When Lee pleaded guilty in March to intercepting wire communications,
    she reportedly told Matsch that she tapped into Ramsay's e-mails
    because she was concerned about the welfare of children her husband
    had with Ramsay.

    Her lawyer, Joe Koncilja of Pueblo, told Matsch, ''I don't see it,
    quite frankly, as a crime.''

    The judge replied, ''I don't agree with your suggestion, Mr. Koncilja,
    that this is an inappropriate prosecution. I've seen people punished
    for opening other people's mail - snail mail. Privacy is still a
    cherished value that each of us has,'' Matsch said. He said he would
    not impose a fine because Lee will have to pay the cost of electronic
    monitoring for her home detention.

    ''It makes your own house your jail,'' he told her.

    ''I really apologize for what I did,'' she told the judge. ''She
    (Ramsay) has a right to feel the way she feels.''

    Ramsay, described by La Junta detective Gary John as ''very upset
    about it,'' has compared Lee's actions to someone breaking into her
    home and reading her diary.

    I see Joel the impersonator, is still blathering about off topic subjects.

    The truth is, he was stopped as impersonation is a serious matter. His account
    was closed while the whole lot of people on smd were balthering, it can't be
    done.
